DEED OF AGREEMENT

                                           

          This Deed  of  agreement for sale  is made and  executed  on  the  ___th   day  of ______^2006

                                                BETWEEN

        Sri, _________________________S/o __________________,                                    By faith _                  By profession  _____________   and resident of __________________,  P.S. ___________,  ,City__________  in  the  district  of  _____________   Assam ( who and his heirs, successors , executors, administrators and legal representatives and assigns are unless the contrary appears hereinafter called the  Seller / First Party on  the one part.

                                                AND

 

       Sri_________________________   ,  S/o.  ________________ by faith __________,  by profession_______________ resident ______________,Assam ( who and his heirs, successors, executors, administrators and legal representatives and assigns , are unless the contrary appears, hereinafter called the Purchaser/Second Party on the other part.

Whereas the  above  named seller is the  absolute owner and possessor of  the plot of land  /                        ,  measuring ____(______) ___________  (                   ) Lechas ,  covered  by Dag  No.  _______________   of   K.P.Patta No. __________________     , Comprising at village  _____________________  under ______________ Mouza  P.S . _________________________  in the  district  of  _____________(Assam)                                                                                                   

Now the  above named  seller has proposed  to  sell the aforesaid plot of land ______________________ to  the  purchaser at a total consideration amount of Rs. ________________ ( Rupees _______________________  ) only   and  WHEREAS  the  purchaser has agreed  to  buy the  same  plot  of land at  the  amount as mentioned  above .

        NOW THEREFORE THIS AGREEMENT WINESSETH AS UNDER :

1)      That the total value of the land  as mentioned above has been finalized at a total consideration amount of Rs. ____________________( Rupees____________________ ) only  , out of which the purchaser has paid an amount  of Rs.                                                     (Rupees                                          ) as earnest   amount  to the seller and the purchaser has also agreed to pay balance amount  on or before execution of the sale deed.

2) That  the expenses for obtaining sale permission will be borne by the seller  and the sale deed will be executed and registered within 30 days from the date of permission from the competent authorities ( DC/GMDA).

3) That in-case of any breach of terms and condition of this agreement and in the event of  the purchaser is deprived of buying the plot of land as mentioned  above, the seller will have to pay double the earnest money to the purchaser . 

4) That in the event of  the purchaser failing to pay the balance amount even after grant of all necessary permission , the seller will have the liberty to

deduct 2 %  of  the finalized  amount , out of the earnest money to be paid back to the purchaser for cancellation of this agreement..

4)  That the  seller has declared that  the aforesaid plot of land  under sale is free from all kinds of encumbrances , charges with the payment of any money  etc.  and further stated  that he/she  will not pledge the scheduled land/property for mortgage, charge and / or for any other purpose after execution of this agreement.

5)  That in the event  of failure on the part of the seller/First Party in execution and registration of the sale deed, the purchaser /second party shall be at liberty to get the sale deed executed and registered through Court of Law.

7) That the seller in case of house/building under sale,  will pay all outstanding G.M.C. taxes/Electricity bills and other revenue taxes etc , that may be in existence at the of execution of this agreement and hand over all such  up- to- date     taxes paid receipts before execution of sale deed registration otherwise the Purchase will deduct the  outstanding amount   if any,   from the sale price.

8) Both the seller and purchaser have gone through the context of the agreement  and agreed to abide by the above terms and conditions and  consented to sign this deed of agreement
